History and Administration

The Section 405 Occupant Protection Incentive Grant program was initially authorized under the Transportation Equity Act of the 21st Century (TEA-21) and reauthorized under SAFETEA-LU. It was administered by the National Highway Traffic Safety Administration (NHTSA) at the federal level and the State Highway Safety Offices (SHSOs) at the state level.

Under MAP-21 (Moving Ahead for Progress in the 21st Century, this program was replaced by Section 405(a) of the Section 405 National Priority Safety Program.

Purpose

This program provided incentive grants to encourage states to adopt and implement effective programs to reduce highway deaths and injuries resulting from individuals riding unrestrained or improperly restrained in motor vehicles.

Requirements

A state was eligible for an incentive grant if it satisfied four of the following six criteria:

Funding

Qualifying states received grants up to 100% of their FY 2003 Section 402 apportionment. The federal matching share was 75% in the first fiscal two years, 50% in the next two fiscal years, and 25% in the final two fiscal years (and beyond). Unobligated funds were able to be transferred into the Section 408 or Section 410 programs.
